CBJ manager to see authorization from Assembly for land deal with Alaskan Brewing

    Juneau, Alaska (KINY) - City Manager Rorie Watt will be seeking authorization from the Assembly at this Monday evening's meeting to negotiate the sale of city owned land to Alaskan Brewing.

    Watt said on Action Line Friday that they own two lots next to the brewery wants to purchase for expansion of its plant.  The city lots are used by the Water Utility staff and the Household Hazardous Waste program.  The city would, in turn, purchase property from Construction Machinery on Anka Street which was formerly know as the Channel Construction yard.  Watt said that would allow the city to consolidate  programs at that location.

    An ordinance up for introduction would appropriate $250,000 to the city's legal defense surrounding its use of marine passenger fees which has been challenged in federal court by the cruise ship industry.

    Another ordinance up for introduction calls for amending the land use code relating to development in the vicinity of eagle nests and habitat.  Watt said the federal view of eagle protection has changed a lot in Alaska.  "They're not endangered and they've gone so far as to realize that statewide a lot of eagles could be lost and the population wouldn't suffer.  And so we're just getting in the line rest of the regulatory authority."

    Watt said the point needs to be made that there's not a lot of available land in Juneau and this change would relax a  regulation impacting land development.  The existing code prohibits development within 330 feet of eagle nests on public land and within 50 feet of eagle nests on private land during the nesting period. This ordinance would remove those development prohibitions.

    Watt said the existing CBJ code related to eagles is difficult to enforce and is unnecessary.  He added that this ordinance is anticipated to reduce costs of development near eagle nests and habitat without any adverse impact on eagles because the eagle population in Juneau is healthy.

    There are no ordinances up for public hearing during the meeting meeting.

    The granting of a conditional use permit by the Planning Commission for a marijuana cultivation facility proposed by Granite Mountain Properties has been appealed to the Assembly.

    Members will first decide if they want to hear the appeal.  If they vote to hear it, they will then decide whether to hear it themselves or appoint a hearing office.

    There are also three new marijuana licenses up for local review that involve a retail store and cultivation and manufacturing facilities proposed by a company named AMCO.  The manager is recommending the Assembly waive its right to protest the issuance of licenses by the state.

    A resolution up for approval would put the Assembly on record in support of full funding from the state's Municipal Harbor Facility Grant Program. The local government has submitted an application for $260,000 for installation of zinc anodes (Ah-nodes) for Harris Harbor and Mike Pusich Douglas Harbor.

    The Assembly is also scheduled to enter into an executive session in part to take up the annual evaluations of Watt and City Attorney Amy Meade.

    The Assembly meeting is scheduled to convene at 7 p.m. in Assembly Chambers at City Hall.
